Updated SDS Statutory Guidance – information sessions for SDSS members

The Scottish Government published the updated SDS Statutory Guidance on 21st November 2022. You can see the newly updated Guidance here: https://www.gov.scot/publications/statutory-guidance-accompany-social-care-self-directed-support-scotland-act-2013-2/

The Guidance has incorporated a number of recent developments, as well as others that have occurred over the last eight years, including:

  • The SDS Standards
  • Parts of the COVID-19 SDS Guidance
  • The Carers (Scotland) Act 2016
  • The Disclosure (Scotland) Act 2020
  • The Promise for children and young people in care

There have been a number of changes and additions to the Guidance, including:

  • A section on the legal considerations concerning the implementation of duties on Local Authorities
  • An update to information on Redundancy
  • An update to information relating to the employment of Personal Assistants, which includes a consideration of their employment status, as employed or self-employed
  • An update to information on Complaints processes
  • Transparency during welfare and financial monitoring of direct payments
  • Data collection on SDS

SDS Scotland are holding information sessions to look at the updated guidance, so that members can have time to consider how this has changed and how this might affect the information they give people. The sessions are taking place on:

  • Tuesday 7th February 2023: 1pm – 2.30pm
  • Thursday 9th February 2023: 11am – 12.30pm
